Equality Bill may lead to costly uncertainty for employers

The long awaited Equality Bill has now been published.

According to the Government this will "strengthen the law and bring forward new measures to fight discrimination". When it comes into force, all current discrimination legislation will be scrapped and replaced with one single piece of legislation. The approach taken is to completely re-write all discrimination law in new, supposedly plain, English. This may appear to make sense and make the law more understandable for all, but what the approach will also do is lead to years of uncertainty whilst employment lawyers argue about whether or not the law has substantively been changed because of the way it has been re-written.
